My Secret Fans is a digital platform that allows adult creators to publish and monetize content and engage digitally with their followers.



The Platform may allow, among other features: public profiles; subscriptions; exclusive content; pay-per-view content; locked content; tips; private messages; video calls; live broadcasts; promotions; credits; communication tools; content links; monetization tools; promotional tools; earnings withdrawal systems.



My Secret Fans acts as the technological operator of the Platform and as an intermediary for certain digital services between Users and Creators.



Unless the Platform itself expressly states otherwise, Digital Fenixly is not the creator of the content published by Creators and does not guarantee the identity, quality, experience, conduct, availability, statements, results, or characteristics of any User or Creator.

For the purposes of these Terms:



User. Any person who accesses, browses, creates an account, or uses any feature of the Platform.



Fan. A User who follows, supports, subscribes to, purchases content from, sends tips to, or uses services offered by a Creator.



Creator. A natural person authorized by My Secret Fans to publish and monetize content via the Platform.



Account. Individual registration used to access the Platform and its services.



Content. Any photograph, video, audio, broadcast, text, message, comment, profile, image, file, audiovisual material, metadata, publication, or other material uploaded, sent, generated, or made available through the Platform.



User Content. Content contributed, uploaded, published, transmitted, or made available by a User or Creator.



Adult Content. Sexual or erotic content exclusively intended for adults, provided it complies with these Terms, applicable laws, payment provider rules, and Platform policies.



Credits. Digital units used within My Secret Fans to access certain features and services.



Balance. Amount of Credits available in a User's account.



Creator Earnings. Amounts recorded in favor of a Creator as a result of purchases, subscriptions, tips, paid content, or other monetization features, subject to the adjustments provided in these Terms.



Payment Provider. Any authorized third party that processes payments, collections, conversions, withdrawals, or transfers related to the Platform.



Withdrawal Method. Any method enabled by My Secret Fans for a Creator to receive their funds, including, when available, Remitly, Western Union, Ria Transfer, Global66, and international bank transfer.



Payout. Payment or withdrawal of available funds to a Creator.

My Secret Fans is a platform intended exclusively for persons 18 years of age or older.



By using the Platform, you represent and warrant that: you are at least 18 years old; you have the legal capacity to enter into this Agreement; you are not subject to a legal prohibition preventing you from using the Platform; you have not been previously expelled from My Secret Fans for a severe violation, unless expressly authorized by the Company; you are not using the Platform on behalf of a minor; and you will not use the Platform to facilitate illegal activities.



My Secret Fans may require additional verifications of age, identity, address, account ownership, authenticity, and other data when deemed necessary for security, fraud prevention, legal compliance, or payment provider requirements.

To become a Creator, the User must complete the onboarding and verification procedure required by My Secret Fans.



Verification may include official ID, photograph, proof of life, facial verification, tax information, banking or withdrawal information, proof of address, additional documentation, and information related to persons appearing in the content.



The Company may use specialized providers to perform these verifications.



Approval of a Creator account does not constitute a guarantee that the Creator will be able to use all payment or withdrawal methods available in all countries.



My Secret Fans may request re-verification when there is suspicious activity, the Creator's data changes, the withdrawal method is modified, there is a chargeback or fraud, it is required by a payment provider or applicable law, or for any other legitimate reason regarding security or compliance.

Each Account is personal and non-transferable.



You may not sell your account, buy an account from someone else, rent an account, transfer it, share credentials, allow access by unauthorized third parties, create automated accounts, use bots to create accounts, create fraudulent accounts, or impersonate anyone else.



You are responsible for maintaining the confidentiality of your credentials.



All activities conducted from an Account may initially be attributed to the holder of that Account, unless there is sufficient evidence of unauthorized access.



You must immediately inform My Secret Fans if you suspect unauthorized access, password theft, session hijacking, fraud, or account compromise.

My Secret Fans may use additional authentication, email verification, phone verification, anti-fraud checks, behavioral analysis, login limitations, temporary locks, and automated detection systems.



We do not guarantee that any system is completely immune to attacks, bugs, malware, or unauthorized access.

Creators retain ownership of the rights they legally hold over their own content.



The Creator's content does not become the property of Digital Fenixly merely by being uploaded to the Platform.



However, by uploading content, you grant Digital Fenixly a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to the extent necessary to host, store, reproduce, encode, compress, transmit, display, deliver to authorized Users, make technical copies, generate thumbnails, add watermarks, protect against unauthorized use, moderate, detect fraud, perform backups, provide the Services, promote the Platform, promote profiles or content when applicable, and comply with legal obligations.



The license relating to the technical operation of the Platform will remain in effect for the time necessary to provide the Services and for the period reasonably necessary to complete security, legal, accounting, dispute, or backup obligations.



When content is used for promotional purposes, Digital Fenixly may use publicly posted material or content for which the Creator has authorized promotional use via the corresponding features.



Nothing in this license transfers the ownership of the Creator's content to Digital Fenixly.

My Secret Fans may automatically apply watermarks, identifiers, metadata, or other technological protection mechanisms to audiovisual content.



These mechanisms may be used to identify the origin of the content, investigate leaks, detect unauthorized redistribution, collaborate with technical providers, facilitate copyright claims, and protect the rights of the Creator and the Platform.



Although we apply reasonable protective measures, we cannot guarantee that a content will not be copied, recorded, captured, downloaded, or illegally redistributed by third parties.



If we detect stolen, leaked, or unauthorized redistributions of content, we may investigate, preserve evidence, submit takedown requests, use DMCA procedures, contact the operator of the relevant page, block related accounts, cooperate with authorities when appropriate, and take civil or legal actions when fitting.

The Creator guarantees that they have the necessary authorizations to publish any content that includes another person.



When other persons appear in sexual or intimate content, the Creator must ensure that: all persons are at least 18 years old; sufficient and legal consent exists; the required authorizations and records exist; no material obtained through coercion is used; the content has not been recorded or distributed without authorization; and necessary records are kept when required by applicable law.



The Company may require documentation of age, identity, consent, or ownership before or after publication.

When applicable, Creators must comply with laws and regulations related to the production, publication, distribution, and record-keeping of explicit sexual content.



This may include requirements related to identification, age, performer records, consent, releases, document preservation, and availability of records for legal inspection.



When legally necessary, My Secret Fans may request copies of such records or sufficient information to demonstrate their existence.



Creators are responsible for providing truthful and complete information.

My Secret Fans may allow consensual adult content between verified adults.



The content must involve only adults, comply with applicable laws, respect the consent of all persons, comply with payment provider policies and internal content policies, not constitute an illegal activity, not use stolen material, and not include persons who appear to be minors.



The Company may prohibit additional content categories when necessary for legal, financial, security, reputational, insurance, payment processor, or risk management reasons.

It is prohibited to publish, solicit, sell, exchange, transmit, promote, or facilitate sexual content involving minors, child sexual exploitation, sexual violence, sexual coercion, human trafficking, sexual abuse, sexual torture, threats used to obtain sexual content or services, content obtained through crimes, intimate images without consent, secret recordings, revenge porn, content obtained through deception or coercion, bestiality, necrophilia, and conduct that contravenes laws or security policies.



Prostitution and sexual services: My Secret Fans is not a platform for contracting, facilitating, promoting, or coordinating prostitution, escorting, or in-person sexual services.



It is prohibited to use the Platform to offer sexual encounters in exchange for money, solicit in-person sexual services, coordinate prostitution, hire escorts, facilitate commercial sexual encounters, or use the Platform as an intermediary for illegal operations.



The existence of permitted digital adult content does not mean that the Platform facilitates in-person sexual services.

It is prohibited to use the Platform to deliberately deceive other Users regarding identity, age, content characteristics, nature of a purchase, offered services, promotions, pricing, content ownership, or expected results.



Editing, retouching, filters, or the use of artificial intelligence tools are not prohibited per se. However, they cannot be used to impersonate someone else, create fake intimate content of a real person without authorization, create non-consensual sexual deepfakes, commit fraud, defame, or deliberately mislead other Users.

It is prohibited to harass, threaten, extort, blackmail, stalk, spread private information, doxx, impersonate, discriminate, incite violence, carry out abuse campaigns, manipulate reporting systems, or use the Platform for illicit activities.



My Secret Fans may take action against behavior conducted via profiles, comments, messages, broadcasts, calls, content, or external systems when directly related to an abuse occurring on the Platform.

Private messages should not be considered absolutely confidential from the Platform operator.



My Secret Fans may access, review, or process private communications when reasonably necessary to provide the service, investigate fraud, investigate abuse, protect users, enforce these Terms, comply with a legal obligation, respond to a court order, or investigate a complaint.

Creators may set subscription prices when the feature is available.



Before the recurring charge, the User must receive sufficient information regarding the price, frequency, recurring nature, and cancellation conditions.



Users may cancel future renewals via the mechanisms enabled on the Platform. Cancellation will normally prevent the next charge and allow maintaining access until the end of the already paid period, unless otherwise stated or legally required.

A Creator may offer paid content when such functionality is available. The price will be shown before confirming the purchase.



Once the content is unlocked, its use will be subject to these Terms, the corresponding access license, content rules, and restrictions against downloading, copying, or redistribution.



Purchasing access to content does not mean acquiring the intellectual property of the content.

My Secret Fans may use a Credit system.



Unless stated otherwise, 1 Credit is equivalent to USD $1 of utility value within the Platform.



Credits are used within My Secret Fans, they are not legal tender, do not constitute a bank account, do not bear interest, are not an investment, do not represent a share in Digital Fenixly, cannot be used outside the Platform, cannot be transferred between users unless expressly permitted by the Platform, and cannot be withdrawn by the User for cash.

Users can purchase Credits using the enabled payment methods.



My Secret Fans may apply a platform fee on top-ups. The current fee may range between 10% and 13%, plus any payment processor fees, taxes, or other charges that legally apply.



The applicable fee will be displayed to the User before confirming the transaction.

Payments may be processed by specialized external providers. The Platform may work with different processors and payment providers.



The provider used may vary depending on the country, currency, transaction type, payment method, risks, regulatory requirements, and the provider's availability and limits.



Users must provide truthful, valid, and up-to-date payment information.

Applicable taxes may be added to the price when required by law.



The exchange rate used in a transaction may depend on the processor, bank, payment provider, or payment method used.



My Secret Fans does not guarantee a specific exchange rate.

Digital purchases are, by their nature, consumable.



Without prejudice to any mandatory rights that may apply to the consumer, purchases of digital content, Credits, tips, and digital services will generally be final and non-refundable once used or consumed.



Refunds may be evaluated in circumstances such as duplicate charging, technical error, clearly unauthorized transaction, content removed for severe policy violations, billing error, or legal obligation.

The unjustified or fraudulent initiation of a chargeback constitutes prohibited conduct.



If a User files a chargeback, Digital Fenixly may temporarily suspend the account, investigate the transaction, request information, contact the processor, present transaction evidence, recover amounts when applicable, and restrict future purchases.

Creators receive 100% of the earnings that the Platform records in their favor according to the current monetization model.



However, chargebacks, refunds, fraud, reversed payments, voided transactions, legally withheld taxes, obligations to providers, fraudulently obtained funds, accreditation errors, or financial obligations of the Creator to the Platform may affect a Creator's balance.



If an amount previously credited to the Creator is subsequently reversed, Digital Fenixly may deduct it from the available balance, deduct it from future earnings, hold future payments, maintain a reserve, offset it against other pending amounts, or recover it through legally available mechanisms.



A negative balance may be considered an amount owed to Digital Fenixly when there is a contractual and legal basis for doing so.

My Secret Fans uses a monetization model in which the revenue assigned to the Creator for their sales on the Platform is credited to the Creator at 100% according to the Creator's price and the Platform's current model.



The platform fee is primarily charged to the User in relation to certain top-ups and operations and is not structured as an ordinary percentage commission on the price set by the Creator.



The "100%" does not prevent adjustments derived from chargebacks, refunds, fraud, accounting errors, legally mandatory tax withholdings, legal orders, legitimate payment provider penalties, specific withdrawal costs or fees, currency conversions, or amounts owed to Digital Fenixly.

Creators may request the withdrawal of eligible earnings through the available methods.



Withdrawal methods may include:



Remitly · Western Union · Ria Transfer · Global66 · International Bank Transfer



The availability of each method will depend on the Creator's country, currency, provider, verifications, limits, legal requirements, technical availability, and provider policies.



Digital Fenixly does not guarantee that all methods are available to all Creators.

Before processing a withdrawal, Digital Fenixly may require identity verification, tax information, beneficiary verification, address, additional information, ownership documents, and anti-fraud checks.



A withdrawal may be delayed when there are disputes, chargebacks, fraud, investigations, verification issues, breaches, legal requirements, or payment provider restrictions.

Creators act as independent contractors and not as employees of Digital Fenixly Group LLC.



These Terms do not create an employment relationship, partnership, joint venture, agency, general commercial representation, or franchise relationship.



The Creator is responsible for their taxes, licenses, permits, tax obligations, professional obligations, social security obligations, and compliance with the laws of their country.

My Secret Fans may offer promotional programs and rewards for Creators who reach certain milestones.



Programs may include rewards associated with income levels such as USD $200, $1,000, $5,000, $10,000, $30,000, $50,000, $100,000, $1,000,000, and $5,000,000.



These rewards may be subject to specific rules, availability, verification, territory, taxes, shipping, and additional conditions.

All rights to the My Secret Fans name, logos, brands, design, interface, software, code, databases, systems, functionalities, texts, graphics, infrastructure, proprietary content, documentation, and visual elements belong to Digital Fenixly Group LLC or its respective licensors.



It is prohibited to copy, reproduce, clone, resell, sublicense, modify, decompile, reverse engineer, extract code, replicate interfaces, build a competing platform using proprietary elements, or use content or data en masse without authorization.

It is expressly prohibited to use scrapers, crawlers, bots, scripts, automations, extraction tools, mass download systems, profile scraping, message extraction, content extraction, or automated data mining without written authorization from Digital Fenixly.



The Platform may block IPs, devices, accounts, sessions, or credentials associated with this behavior.

Creators may not use My Secret Fans to bypass Platform fees or controls.



It is prohibited to use the Platform to direct Users to external payments, personal transfers, PayPal, Cash App, cryptocurrencies, personal bank accounts, or other processors when the purpose is to evade My Secret Fans' monetization mechanisms.



Digital Fenixly may establish specific link or external checkout features when expressly authorized.

A Creator may work with an agency or manager provided the relationship is managed according to My Secret Fans' rules.



The Creator will remain responsible to Digital Fenixly for their account, content, obligations, representations, and compliance.



The Platform may require specific documentation before recognizing a third party as an authorized administrator.

Artificially generated or assisted content may be allowed provided it complies with these Terms and applicable laws, does not infringe on third-party rights, does not impersonate real people, does not constitute a non-consensual sexual deepfake, and does not use the face or identity of another person without authorization.



The Company may require that certain categories of AI-generated content be identified as such.

My Secret Fans may use a combination of automated systems, artificial intelligence, pattern detection, anti-fraud tools, human review, User reports, post-publication review, and pre-review for certain content categories.



We do not claim that absolutely every piece of content is manually reviewed before being published.



The Company may reject, limit, demonetize, hide, remove, restrict, or suspend any content that violates these Terms or poses a legal, financial, security, or community risk.

Users may report content or accounts they consider to be infringing. Moderation decisions may be subject to internal review when the Platform has an appeals process available.



When a decision has been made by automated systems, Digital Fenixly may indicate this circumstance when required by applicable law or when appropriate.



Certain details may be omitted when revealing them would prejudice an investigation, compromise anti-fraud systems, affect third parties, reveal security mechanisms, or violate a legal obligation.

My Secret Fans respects intellectual property rights.



The Platform may maintain a separate DMCA procedure for takedown notices, counter-notices, claims, repeat offenses, and copyright infringements.



Rights holders may submit claims according to the procedure published by the Platform.



Digital Fenixly may remove or disable access to the material that is the subject of a valid claim and may take other actions permitted by law.

My Secret Fans strictly prohibits the publication of intimate content of a person without their consent.



When a report related to non-consensual intimate content is received, the Company may immediately restrict the content, remove it, preserve evidence, investigate the account, block the responsible party, cooperate with authorities, and take measures to prevent republication.

Digital Fenixly may take action against Users who are subject to sanctions, use the Platform in violation of embargoes, attempt to defraud the Platform, violate legal restrictions, or use payment services fraudulently.



Additional information may be requested to verify the identity, source of funds, or legitimacy of transactions.

The Platform may use systems designed to detect card fraud, account takeover, friendly fraud, multiple accounts, false identity, anomalous behavior, suspicious transactions, chargeback abuse, promotion exploitation, money laundering, and balance manipulation.



A transaction may be temporarily held while an investigation is completed.

When there is a reasonable risk of chargebacks, fraud, reversal, claim, breach, KYC issues, legal obligations, or illicit activity, Digital Fenixly may maintain a reserve or hold on certain amounts.



The hold does not necessarily imply that the Creator has committed an infraction.

Digital Fenixly may suspend, restrict, or terminate an Account when it reasonably considers that these Terms have been breached, fraud exists, there is financial risk, there is a threat to the Platform, content policies were violated, verification issues exist, illegal activity is present, chargeback abuse occurred, unauthorized automations were used, a legal obligation exists, or the payment provider demands the restriction.



When applicable, we may provide a general reason for the decision.

A User may stop using the Platform at any time.



A Creator may request the closure of their Account through the available mechanisms.



Closure does not automatically extinguish debts, tax obligations, chargebacks, indemnities, claims, confidentiality obligations, licenses that must survive, legal obligations, or pending disputes.

An Account may be considered inactive when it does not register activity for a prolonged period defined by the Platform.



Digital Fenixly may request re-verification of identity before reactivating an Account.



Funds will not be deleted simply to generate a profit for the Company when applicable legislation requires their retention or payment.



Unclaimed balances may be subject to the corresponding unclaimed property rules.

After the closure of an Account, Digital Fenixly may delete the content, keep backups, retain certain data for legal reasons, retain information necessary for fraud and security, keep financial records, and preserve evidence linked to an investigation.



Technical deletion may not be instantaneous across all backup systems.

Digital Fenixly may add features, remove features, modify prices, change systems, change providers, change payment methods, change withdrawal methods, update infrastructure, modify policies, and perform maintenance.



When a material change significantly affects Users, we may provide notification when legally required or reasonably appropriate.

The Company may update these Terms to comply with new laws, introduce services, change business models, correct errors, improve security, incorporate new providers, modify processes, or protect the Platform.



The new version will be published with its update date.



When required by law, additional notification will be provided.

The Platform is provided "as is" and as available.



We do not guarantee permanent availability, the complete absence of errors, the complete absence of interruptions, the complete absence of attacks, the functioning of third parties, the availability of a particular payment method, or the availability of a particular withdrawal method.



We may perform emergency maintenance without prior notice.

My Secret Fans may rely on third parties for hosting, storage, payment processing, identity verification, anti-fraud, email, messaging, video, streaming, transfers, withdrawals, analytics, and security.



The services of these third parties may be subject to their own terms and conditions.

Each User is responsible for their own content.



Digital Fenixly does not automatically adopt the views, statements, or representations made by Users as its own.



The Company may remove content when it reasonably determines that it violates the Terms, violates the law, a valid claim exists, there is a risk to the Platform, a provider obligation exists, or there is a risk to third parties.

To the maximum extent permitted by applicable law, the Platform is provided "as is" and "as available".



We do not guarantee economic results, number of fans, number of sales, minimum income, audience growth, virality, permanence of content, absence of leaks, permanent availability, or compatibility with any device.

To the maximum extent permitted by applicable law, Digital Fenixly, its owners, affiliates, contractors, employees, providers, and agents shall not be liable for indirect, incidental, special, exemplary, or consequential damages, including losses derived from profits, revenue, business opportunities, reputation, data, interruptions, third-party content, leaks by third parties, unauthorized access, conduct of other Users, decisions of payment providers, internet issues, or third-party infrastructure failures.



Nothing in these Terms shall exclude or limit liability that cannot legally be excluded or limited.

To the extent permitted by applicable law, the aggregate liability of Digital Fenixly arising from these Terms or the use of the Platform shall not exceed the greater of:



1. the amount actually paid by the claimant to Digital Fenixly for Platform Services during the twelve months prior to the event giving rise to the claim; or

2. USD $1,000.



This limit shall not apply to the extent that applicable law prohibits limiting certain liability.

To the maximum extent permitted by law, the User agrees to defend, indemnify, and hold harmless Digital Fenixly, its affiliates, owners, officers, employees, agents, contractors, and providers against claims, losses, damages, liabilities, and reasonable expenses, including legal fees, arising from User content, violation of these Terms, fraud, intellectual property infringement, violation of third-party rights, illegal conduct, violation of consent, misuse of the Platform, the User's tax obligations, or the User's conduct towards other Users.

Creators guarantee that they possess the necessary rights, have the necessary authorizations, have permission from the people appearing in their content, do not use stolen material, do not infringe third-party rights, comply with applicable laws, comply with content rules, comply with age requirements, and maintain legally required documents.



If Digital Fenixly incurs expenses as a result of an infraction attributable to the Creator, it may exercise the indemnification rights set forth in these Terms.

Digital Fenixly may take reasonable measures to combat leaks.



However, no technical system can guarantee that a third party will not copy content.



The Company shall not be automatically liable for screenshots, screen recordings, external cameras, recording with another device, redistribution on external websites, or leaks occurring outside its infrastructure.



When reasonably possible, we will collaborate with the Creator to pursue illicit uses of the content.

Digital Fenixly will not be liable for delays or interruptions resulting from events beyond its reasonable control, including natural disasters, wars, terrorism, epidemics, massive internet failures, power outages, provider failures, cyberattacks, regulatory changes, sanctions, government decisions, processor failures, banking interruptions, or problems with international transfer services.

The processing of personal data shall be governed by the My Secret Fans Privacy Policy, which forms part of this Agreement by reference.



Information may be processed to create accounts, provide Services, verify identity, prevent fraud, process payments, process withdrawals, comply with legal obligations, respond to complaints, maintain security, and exercise legal rights.

Digital Fenixly may cooperate with judicial authorities, law enforcement, regulatory authorities, child protection agencies, intellectual property bodies, financial providers, and tax authorities when there is a legal basis to do so.



The Company may preserve information and content when there is a reasonable legal obligation or need.

If a person claims that certain content infringes their rights, Digital Fenixly may request information, temporarily restrict the content, remove it, notify the Creator, preserve evidence, request a counter-notice, and cooperate with legal proceedings.



Creators will be responsible for defending their own rights when the dispute relates to them personally, without prejudice to any assistance Digital Fenixly chooses to provide.

The Company may implement other support channels within the Platform.



We do not guarantee a specific response time unless an applicable policy or law establishes one.

The parties will attempt in good faith to resolve disputes through support or direct communication before initiating formal proceedings, except when there is an urgent reason to go directly to an authority or court.



Nothing in this clause prevents exercising rights that cannot legally be waived.

To the extent permitted by applicable law, these Terms shall be governed by the laws of the State of Wyoming, United States, without prejudice to mandatory rules that may apply to the User based on their country of residence.



When the User has non-waivable legal rights under the laws of their jurisdiction, such rights shall prevail over any incompatible contractual provision.

For disputes with Creators or Users where arbitration is legally valid and applicable, the parties may agree to resolution through individual and binding arbitration administered by the American Arbitration Association ("AAA") or by the arbitral institution indicated in the applicable version of these Terms.



The existence of this clause will not prevent urgent requests for injunctive relief, proceedings related to intellectual property, trade secret protection, claims that legally must be resolved before a court, or consumer rights that cannot be waived.

Digital Fenixly may go directly to competent courts when necessary to protect its trademarks, code, software, trade secrets, combat scraping, combat piracy, prevent illegal redistribution of content, protect infrastructure, or request injunctive relief.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.



The failure of Digital Fenixly to enforce any right or provision immediately does not constitute a permanent waiver of such right or provision.

The User may not assign or transfer their rights or obligations under these Terms without Digital Fenixly's consent.



Digital Fenixly may assign its rights and obligations to an affiliate, purchaser, successor, or as part of a reorganization or sale of assets or business, always in accordance with applicable law.

These Terms, together with the policies incorporated by reference, constitute the entire agreement between the User and Digital Fenixly regarding the use of My Secret Fans.

Provisions that by their nature should survive termination shall survive the closure of the Account.



This includes, among others, intellectual property, licenses, indemnification, liability, disputes, financial obligations, chargebacks, taxes, privacy and legal data retention, confidentiality, and compliance with legal obligations.

The Company may provide translations for convenience.
